AC21 on W2 with consulting company.
I am planning change from GC employer A(consulting) to employer B(consulting) from next month. Mine is EB2 (PD 6/2006 and India), I140 approved 3 yrs ago and I485 pending for 2 yrs.
The new position is an hourly contract opportunity on W2 with same and similar responisbilities specified in my LC (LC has hourly as salary type).
The employer B may give employment letter with same roles and responisbilities and mention contract opportunity with higher hourly rate mentioned in the LC. But they may not give a letter indicating "full time" or "permanent". Does the letter must contain "permanent"? or "contract" can be OK?
What should be min requirment in order to avail AC21 in this scenario? Do you see any issues and what would be required letter content?
