Q.

Green Card via new employer

Case Details: I am currently in my last stage of EB3 based Green Card

Priority Date - Oct 2002
I-1485 filed in June 2007
I-140 approved in 2006

I left my employer in 2008 and am currently pursuing MBA on EAD/AP. Post-MBA, I want to join a new employer in a completely different job area.

Question A - Can the new employer file a green card for me and retain my original priority date? I am not sure if my original I-140 has been withdrawn or not, but I haven't received any letter from USCIS indicating that.

Question B - Can the new employer file H1B for me even though I have exhausted my quota of 6 years for H1B?
