H1B in 7th Year, Perm denied. Further Options

I am in my 7th Year H1B and its valid until August 2010. My Perm application just got denied due to wage factors which are attorney's typo mistake. MTR has already been filed. What are my options now?
1) Can I get my H1B extended on the basis of pending appeal. Given the situation right now, high scrutiny, what are the chances of getting H1B renewed?
2) Can I apply for a new perm with a new employer to be safe? Is it better to apply with a new employer or current employer? I know we have to go through revoking the appeal to file with current employer. Which is better?
3) If I file a new Perm with a different employer, how can that be worked out. Even if it gets approved and we file 140(premium) and get that approved, how will I be able to transfer my H1 and get 3 year extension?
