Q.

Which priority date will be considered for me?

I want to apply for I-485 under 245(i) based on an labor certification application date of Dec 2000 that was approved. The I-140 attached to this labor was also approved and later revoked(after more than 2/3 years). The reason is not known for revocation. My I-485 related to this I-140 was denied because I had left the country. However, I was given an opportunity to use AC21 law and provide an employment letter with new employer.I could not respond as I left the country in 2003,thereby my I-485 was denied. After returning back in 2006,I have a new approved EB3 India I-140 with new labor and new employer with a priority date of July 2006. If I can use my priority date of Dec 2000,I am eligible for applying I-485.Can I claim my old priority date while I apply for I-485.If so how?
