Q.

Changing roles within the same company after I-140

Hi,

I have a couple of questions. My I-140 was approved last week. Waiting for 485 to become current. Application date Sep 2007.

1.My lawyer filed my labor cert in EB3 category on the grounds that my education + experience equal a bachelor's degree. (even though at the time of PREM, i had 16 years of full time education). Can something be done now to change my category to EB2 without having to go through a new PERM process?
2. I work at corporate headquarters of a large congolmerate and want to transfer to another subsidiary (100% owned by the same conglomerate), can I do that and still keep my application date?
3. My 2nd H1B expires in Jun. I also have option to go work for another company, is there enough time transer H1b & start PERM fresh from that company? Thanks
