Q.

H4 Denial

My situation, I-140 approved, I-485 pending more 180 days, have a 3 year (till 2012) H1 based on I 140 approved in Jan this year. My comp. didn’t extend my wife’s H4 for 2 months starting Jan since she is AOS pending and in status. I insisted with my company that we renew her H4 as well, as I heard that she will lose her H status if the H4 is not renewed. We sent the renewal about 5 months back and 2 months back her H4 was denied under Title 8 CFR 248.1.a. My company didn’t inform me and appeal this denial. Questions-Has she lost her H status totally since her H4 was denied, we travelled to India on AP after her H4 renewal application was submitted to USCIS i.e. at that time she was on AOS only?
Can she get back on H1 if needed in the future she was on H1 before from 2000 to 2001.
