Q.

I-140 and change of employer

My I140 and I-485 were filled in august of 2007. I-140 was approved in august 2009.The lawyer made a mistaike in filing it under
EB-3 when it should have been EB-2.
Now he has sent a letter to USCIS to change it to EB-2.I have a M.S. in computer science from a american university.I have looked at
my labor
and it is not specified that the job should require a Masters degree.I have a EAD.

Is it okay to change the employer now when the request for I-140 amemndment is on?
