Q.

AP approved on EB3 but benificiary never worked,need to reenter

1,My husband was filed on EB-3as skilled worker but never worked for employer andI-140,EAD and AP approved for husband and myself.My question is whether he would be called for interview prior to get the Green card if so what we should be considered to show them that he is still working with the employer but unfortunately employer closed the business 6 months back advice me on this
2, We are traveling to home country for 2 months on AP is valid up to 10/2010 but I want to know since he never worked for the employer,CBP may find that he is not working we may not eligible to reenter
3,I am working on EAD now,I used to work in the Foriegn Consulate and still that A2 Visa valid till 2011,can we show A2 visa at the POE as I94 shows D/S, DOS was intimated my termination,can CBP find at POE
