I have 2 questions -- My situation - 140 has been approved, received EAD for me and my wife. We have not used EAD but travelled on Parole, I 485(AOS) pending, I am continuing on H1 with sponsoring employer. If my wife uses EAD (not me i will continue on H1) for work and for some reason 485 gets denied will she be able to get back on H status i.e H1 or H4 and can we interchange statuses i.e I come on H4 and she on H1 since she is derivative applicant? She has 4 years of H1 status remaining that she can use.

Also since i travelled on Adv. Parole (expiring in Feb 2010)do i have to keep renewing my Adv parole since the date on my I 94 is only for 1 year i.e until Oct 2010
