Q.

I-140 RFE

Hi ,

My I-140(EB-2) was filed on 09/15/2009 in premium process. We received RFE saying 'The Labor Certification, as certified by the DOL based on the petitioner's requirements, does not permit experience and education to be obtained concurrently'.

On my perm
Education Minimum Level Required is : Masters
Experience required : 24 months

I finished my masters in July 2007( Actually I finished all the course work except my thesis in 2004 Aug and Started working from then . I Defended my thesis in July 2007 and got masters certificate) and my labor was filed in Oct 2008.

What ever experience mentioned in the perm has to be after the education mentioned in the perm?

What are my chances of getting 140 approved and how do we do it?
