Q.

AC21/EAD. H-1 transfer.

Hi, my case details:

- Employed on H-1B (2nd term, valid until Mar 2011)
- LC, I-140 approved, PD Mar05 EB3, I-485(AOS) pending for 2 yrs
- EAD valid until Jan 2011, AP until Jan 2010 (not using either)

I'm planning on starting employment with a much smaller company (<10 employees) in San Francisco (similar job - S/W engineer) and use approved EAD thereby invoking AC21.
1. Aside from filing form I-9, does new company need to do anything for my GC petition to continue w/o issues? Don't want to jeopardize it.
2. Can new company apply for H-1 transfer and keep the approved H-1 in case it is needed in the contingency scenario of 485 denial? I do want to start employment however on EAD. Just wondering if H-1 transfer can be initiated and approved H-1 "saved" for the future?
