Q.

Changing a pending AOS to CP Questions

Me and my wife have pending AOS(I-485). I am under EB3-ROW and my wife applied as dependent. We already completed our medicals, submitted RFEs, but my PD is retrogressed. We are currently in Canada with AP, and I like have our US GC processes transferred to Canada for Consular processing.

1. Do I have to file 2 separate I-824 to transfer our cases to NVC? do I have re-submit all the documents again e.g. employer letter? can't they be transferred from USCIS?

2. Do I have to submit affidavit of sponsorship for my wife? I don't think that was necessary when I filed I485 for her.

3. Can we bypass NVC if we do CP in Canada?

4. How difficult is the overall process, is it really necessary to have lawyer?

5. Is there any problem if we apply for Canadian PR while CP?
