Q.

Status if I leave or loose my job

Thanks a lot for your guidance and precious time. I am currently on H1B. I just wanted to request your opinion to the following situation.

1) If I leave my H1B employer I will be OOS. Some lawyers say you can still file EB1A I-140 and I-485 concurrently within 180 days after I resign from H1B employer and since this will put me back on AOS I will be fine this. Is this true? Can I do this?

2) If I resign from H1B employer and then file I-140 and I-485 to get on AOS- what happens if I get another job in a few months. Can I convert back to H1B while living in the country.

3) If I resign from my H1B employer, can I stay on for 4-5 months without even filing a new I-140 and I-485. I realize I will be OOS. Can I simply stay and finish my ph.d then leave the country.
