I am a US citizen and my mom has a B2 visa for 12 yrs. Her I-539 got denied yesterday. We didnt apply for a GC since she wants to spend more time in India than here. 1) Is there anything we can do to appeal the denial. 2) She is 75 years old , and doesnt want to leave in 10 days (she is with my brother for only 2 wks). She wants to go back with my brother in 3 months. Will they know at the US airport when she leaves, that she overstayed and detain her in Boston. 3) Can a POE officer deny entry later (if she ever comes again viz.worst situation for us). Can her B2 get cancelled? She wants to spend 3 months now since she is unlikely to come back even in <3yrs. 4)Can I apply for her GC now to keep her stay legal? Even if I apply-she is GOING back in 3 months. Is it worth to pursue this route?
