Q.

Returning to USA on Visa Waiver After Being Here 6 Months on B2

I am a 25 year old Austrian female who graduated university in Vienna in '08. I have a friend in NY and we decided to travel the USA for an extended period. I first came to the USA on the 90-day Visa waiver March '08 and stayed through May '08. I returned to the USA July 31 '08 on a 6-month B2 Tourist Visa that ended January 30 '09. April 9th my I-539 Application to extend my Visa for an additional 6 months was denied. I must leave by May 9th to avoid loss of status. We still have travel plans and I want to return as soon as possible on another Visa waiver.

1) What would be a safe time period to wait to avoid rejection at the airport? I hope 1 month is sufficient. 2) I entered the diversity lottery (tba 7/1/09) and I do not want to risk my lottery chances w/a rejection in my file.
