Visitor Visa for Inlaws.
My current H1B petition is expiring on 11th Jan 2011 & the Visa stamp on my passport expired back in Sep-2008.
My Company recently applied for another H1B extension in October 2010.
I have received the Form I-129 Receipt Notice from USCIS & waiting for Approval.
I am planning to invite my in-laws to the US with a Visa appointment date sometime in Jan/Feb-2010.
As you can see I neither have a Valid Visa on my passport nor an approved renewed petition.
Can I use the I-129 Receipt Notice in lieu of the Visa/approved petition to prove my legal status in the United States?
Just in case if I can get an appointment prior to 11 Jan 2011, will the Visitor Visa be rejected considering that my H1b current petition is expiring in Jan-2011/the H1b extension is pending approval
Please advice.
