to file I-539 or not?
I am a U.S Citizen. I filed forms I-130,I-864EZ,G-325A for my husband(who is on B2 visa now in U.S.A and his I-94 expires in May 3rd 2010).
My husband has concurrently filed with me the forms I-485, I-765, I-131(advance parole),I-693, G-325A on Jan 2nd 2010.
He has received acknowledgment receipts from USCIS regarding his forms, also listing his USCIS A#
He has also received biometrics appointment on Jan 22nd 2010 and got fingerprinting done.
My question is does he have to file I-539 now and extend his B2 visa till the time he gets EAD/Green Card.
Is filing I-539 advisable now?
