B1 Visa Application

Hi..Me and my mom-dad r in US on Immigrant visa and also got our GC in april this year. Well my elder brother is 25 and is in India. When he was in UK for studies he was a victim of ragging and got himself in atempt to fraud crime and he was jailed for a day and also he did community service for a week. The court said that his crime report will be disposed after 5 years. As the courst came to know that he was a victim of ragging. He wants to apply for B1 visa now for a visit to his company in US. So shall he mention about his crime in UK on application? If he doesn't mention it then can it be traced later? Please guide me and also let me know the best way to get out of it. If he needs to mention it then please let me know how can he convince the consulate officer.
